“Shedgate” Case Dismissed!
“Denied… Denied… Denied… Denied.”
IN THE APPELLATE COURT OF THE EIGHTEENTH JUDICIAL CIRCUIT IN AND FOR BREVARD COUNTY, FLORIDA
CASE NO: 05-2022-AP-025737-XXXX-XX
On June 15, 2026 Circuit Judge Kathryn M. Speicher dismissed Funoe, LLC’s, aka Alison Dennington, case against the Town of Melbourne Beach. This case, dubbed “Shedgate”, has been in litigation since 2020.
The Town was forced to hire an outside attorney, Elizabeth Harris, from Harris Appellate Law to handle the appeal after Dennington, aka Funoe, lost her code enforcement violation AND at the special magistrate hearing.
The total cost for Harris Appellate Law is $27,918.00 to date. We, the people of the Town of Melbourne Beach, had to bear that cost. This was a total waste of time and taxpayer dollars! It’s important to note that these legal fees do not include the cost of the Special Magistrate, the Town Attorney, other consultants as well as Town Staff time.
WOULDN”T IT BE NICE IF OUR TOWN COULD HAVE SPENT THAT MONEY ON STORM WATER NEEDS…
No one benefitted from this… not even the Denningtons (aka Funoe, LLC). Their personal agenda against the Town accomplished NOTHING.
